Welcome to Diamonds and Pearls Boudoir (“DPB,” “we,” “our,” or “us”). By accessing our website, submitting an inquiry or application, scheduling a consultation or session, or purchasing photography services or products, you agree to these Terms of Use (“Terms”).

Please read these Terms carefully. Additional terms contained within your photography agreement, invoice, payment plan agreement, model release, or other signed documents may apply to your specific booking.

1. Acceptance of Terms

By using our website, scheduling a consultation or photography session, entering a promotion or campaign, signing an agreement, submitting payment, or purchasing products or services from Diamonds and Pearls Boudoir, you acknowledge that you have read, understood, and agree to these Terms.

Specific bookings may require a separate signed photography agreement. If additional policies or requirements apply to your particular session, they will be provided during the booking process.

2. Photography Services

Diamonds and Pearls Boudoir provides professional boudoir and portrait photography experiences for women age 21 and older.

Our services may include professional hair and makeup, access to our client closet when applicable, photography, same-day image reveals, digital image collections, albums, wall art, and other photographic products.

Services, sets, products, collections, pricing, promotions, and availability are subject to change.

A consultation is required before booking unless otherwise stated by Diamonds and Pearls Boudoir.

3. Session Fees, Purchases & Payments

Session Fee:

Our standard session fee is $500 unless waived or modified as part of a specific promotion, campaign, giveaway, or offer.

Any required session fee, retainer, or deposit is non-refundable and non-transferable. A booking may only be used by the person originally scheduled unless Diamonds and Pearls Boudoir provides written authorization otherwise.

Minimum Purchase:

Our standard minimum purchase is $1,500 unless a specific promotion, campaign, or written agreement states otherwise.

Waiving a session fee does not waive the minimum purchase requirement unless explicitly stated in writing.

Payment Plans:

Interest-free pre-session payment plans may be available for up to 12 months. All required payments must be completed before the scheduled photography session unless otherwise agreed to in writing.

We do not offer post-session payment plans. Products, images, or portions of an order will not be delivered before the balance is paid in full.

Third-Party Financing:

Depending on availability and approval by the individual provider, clients may have the option to use third-party payment or financing services such as Afterpay, Affirm, Klarna, or PayPal Credit.

Approval, terms, interest, fees, and repayment requirements associated with third-party financing are determined solely by the financing provider.

4. Cancellations & Rescheduling

All payments made toward session fees, retainers, products, collections, or payment plans are non-refundable unless otherwise required by law or specifically agreed to in writing.

Rescheduling:

Requests to reschedule a session less than 30 days before the scheduled session date are subject to a $300 rescheduling fee.

Additional restrictions may apply if a session has previously been rescheduled or was booked through a special promotion, campaign, giveaway, or content call.

Cancellation:

Sessions canceled 30 days or less before the scheduled session date may be subject to a $500 cancellation fee.

Sessions canceled 14 days or less before the scheduled session date may be subject to a $750 cancellation fee.

Any cancellation or rescheduling terms contained in the client's signed agreement will govern that particular booking.

Studio Cancellation:

In the rare event Diamonds and Pearls Boudoir must cancel or reschedule a session because of illness, emergency, severe weather, studio conditions, or another circumstance outside our reasonable control, we will work with the client to reschedule.

If we are unable to provide the contracted services, any remedies will be handled according to the client's signed agreement and applicable law.

5. Promotions, Giveaways, Campaigns & Content Calls

Promotional sessions, giveaways, campaigns, model calls, and content calls may have additional eligibility, payment, cancellation, rescheduling, image-use, or participation requirements.

A waived session fee, complimentary service, product credit, or promotional credit does not mean that the entire photography experience or product purchase is free unless specifically stated in writing.

Promotional credits have no cash value, are non-transferable, and cannot be redeemed for cash unless otherwise stated.

Clients participating in special promotions are responsible for reviewing and complying with the specific terms provided for that offer.

6. Client Responsibilities

Punctuality:

Clients are responsible for arriving at their scheduled time. Late arrival may result in a shortened session or changes to the photography experience. Significant lateness may result in cancellation or rescheduling pursuant to the client's agreement.

Preparation:

Clients are responsible for following preparation, wardrobe, hair, skincare, and other instructions provided before their session.

Client Closet:

Access to the Diamonds and Pearls Boudoir client closet is a courtesy offered with qualifying sessions at locations where the closet is available. Specific pieces, sizes, styles, or accessories cannot be guaranteed.

Guests:

Guests are not permitted at boudoir sessions unless Diamonds and Pearls Boudoir provides prior written approval.

Conduct:

We maintain a professional and respectful studio environment. Diamonds and Pearls Boudoir reserves the right to end a session if a client or accompanying individual engages in threatening, abusive, harassing, unsafe, illegal, or inappropriate behavior.

Animals & Weapons:

Animals and weapons, including firearms, are not permitted inside the studio unless specifically authorized in writing in advance. Service animals are handled in accordance with applicable law.

7. Image Copyright, Privacy & Usage

Copyright:

Diamonds and Pearls Boudoir retains copyright ownership of photographs created by the studio as permitted by applicable copyright law.

Purchasing digital images or physical products does not transfer copyright ownership to the client.

Personal Use:

Clients purchasing digital images receive permission to use those images for personal purposes. Images may not be sold, entered into commercial use, reproduced for profit, or provided to another business for advertising or commercial purposes without written authorization from Diamonds and Pearls Boudoir.

Image Editing:

Clients may not substantially alter, manipulate, or apply filters that materially change the appearance or artistic integrity of professionally edited images when representing them as the work of Diamonds and Pearls Boudoir.

Your Privacy:

Boudoir photography is personal, and we take client privacy seriously.

Diamonds and Pearls Boudoir will not publicly share a client's boudoir photographs for portfolio, website, social media, advertising, educational, or marketing purposes without the appropriate permission or release from the client.

Purchasing a session or products does not automatically grant us permission to publicly share your images.

Clients may decline permission to share their images unless image usage is an expressly disclosed requirement of a particular content call, model call, or promotional agreement accepted by the client.

8. Image Selection, Products & Delivery

Image Selection:

Clients select images and products according to the collection or ordering process associated with their session.

Payment in Full:

All digital images, albums, prints, wall art, acrylic products, and other products must be paid in full before delivery or production unless otherwise agreed to in writing.

We do not deliver portions of an order while an outstanding balance remains on the order.

Custom Products:

Albums, prints, wall art, and other photographic products are custom-made specifically for each client. Because of their personalized nature, all sales are final except where otherwise required by law or in cases involving a verified manufacturing defect.

Delivery Timelines:

Estimated production and delivery timelines may be provided when an order is placed. These timelines are estimates and may be affected by album manufacturers, laboratories, shipping carriers, supply availability, holidays, weather, or other circumstances outside our control.

9. Creative Control

By booking Diamonds and Pearls Boudoir, clients acknowledge that they are hiring the studio based upon its established photographic style and artistic approach.

Diamonds and Pearls Boudoir maintains creative discretion regarding posing, lighting, composition, image selection, retouching, editing, and final presentation consistent with the services purchased and the client's signed agreement.

We cannot guarantee replication of another photographer's work or a specific photograph found online.

10. Appearance & Results

Every person photographs differently. Individual results may vary based on factors including body proportions, wardrobe, posing, lighting, hair, makeup, skin, facial expressions, mobility, location, and other circumstances.

Diamonds and Pearls Boudoir does not guarantee that a photography session will produce a particular emotional, personal, or physical outcome.

11. Limitation of Liability

Diamonds and Pearls Boudoir takes reasonable care to maintain a professional studio environment.

To the extent permitted by law, Diamonds and Pearls Boudoir is not responsible for loss, theft, or damage to personal belongings or delays caused by circumstances outside our reasonable control.

Clients are responsible for communicating any physical limitations or accessibility needs that could affect posing or participation so reasonable accommodations can be discussed when applicable.

Nothing in these Terms is intended to waive rights or protections that cannot legally be waived under applicable law.

12. Website Use

Content appearing on the Diamonds and Pearls Boudoir website, including photographs, written content, branding, graphics, logos, videos, designs, and other materials, may be protected by copyright, trademark, or other intellectual property laws.
